Conveyancer or Property Lawyer?

      By Luke Martinez

      So you're interested in buying property? That's great, but now who do you turn to in making sure those dreaded ‘I s’ are dotted and ‘T s’ are crossed?  You have two options: A Conveyancer or a Property Lawyer. You might be thinking “what's the difference between them and what will each of them cost me?” But are you really comparing apples with apples?

      First of all, there are quite a number of differences between the two. Firstly, a Property Lawyer will perform all of the functions of a Conveyancer that are involved in a property transfer, no matter which part of the transaction you’re completing.

      What a Property Lawyer can do in addition to this:

      • Provide legal advice in relation to the contractual terms;
      • Provide advice in relation to transfer duty.
      • If complications arise, a Property Lawyer is already in a position to assist you with any legal disputes; and
      • Assist you in the resolution process for any disputes, and where applicable assist in protecting you wherever possible.

      In today’s world, complications can and probably will arise. If you find yourself in a dispute and working with a Conveyancer, they may be required to refer you to a Lawyer anyway. So that cost saving you have budgeted for may be gone before you know it.

      With that in mind, when you’re in the midst of a property purchase make sure you're comparing apples with apples. It’s clear that the two of these professional services are not the same. However, given that your property purchase maybe the biggest single purchase in your life, wouldn’t you want to have peace of mind that you’re working with the right professionals straight away?
