Public Liability Claims

Public Liability Claims

If you have suffered an injury which is the result of somebody else's actions, then you may be able to make a compensation claim under public liability laws.

This applies to many types of accident whether on public or private property, in the air or at sea.

An injured person can successfully claim compensation provided they can demonstrate a 'duty of care', a breach of that duty, and consequent harm or loss.

If you would like to know more, or would prefer to speak to someone, make an enquiry now and we will be in touch with you very soon.  Please note that if your injury prevents you from travelling to see us, we'll travel to see you.

Types of accidents covered

Public liability claims are available in many circumstances, including:-

  • Accidents in public places (eg footpaths, parks and schoolyards)
  • Accidents in privately owned facilities (eg shopping centres, amusement parks and homes)
  • Aircraft/boat accidents
  • Injuries caused by animals
  • Injuries in rental properties
  • Sporting injuries
  • Physical/sexual assaults

Who pays the compensation?

Any individual, business or organisation can be liable for any act or omission which results in the injury (or death) to any person.

However, in most instances it is their insurer that actually pays the compensation.

What can I claim?

You can generally claim:

  • Loss of earnings
  • Medical, rehabilitation and other expenses
  • Pain and suffering
  • Home help in some circumstances

Are there time limits?

Yes - there are strict time limits.

In most cases there is a 3 year time limit from the date you were injured.

There is also a requirement that notice of a claim be provided within 9 months of the accident (or first appearance of symptoms), although this can be done later provided there is a reasonable explanation for the delay.

You should consult a lawyer immediately to protect the rights of you and your family.

What will it cost?

We work on a no-win no-fee basis, so you will only pay our legal fees if we win your case.

The cost will depend on the amount of work required to resolve your claim and every claim is different. We are happy to advise you on your situation during a free consultation. Contact us now to make an appointment.
