Public liability claims are available in many circumstances, including:-

  • Accidents in privately owned facilities (eg shopping centres, amusement parks and homes)
  • Aircraft/boat accidents
  • Injuries caused by animals
  • Injuries in rental properties

  • Physical/sexual assaults

Who pays the compensation?

Any individual, business or organisation can be liable for any act or omission which results in the injury (or death) to any person.

However, in most instances it is their insurer that actually pays the compensation.


What can I claim?

You can generally claim:

  • Loss of earnings
  • Medical, rehabilitation and other expenses
  • Pain and suffering
  • Home help in some circumstances

Are there time limits?

Yes - there are strict time limits.

In most cases there is a 3 year time limit from the date you were injured.  

There is also a requirement that notice of a claim be provided within 9 months of the accident (or first appearance of symptoms), although this can be done later provided there is a reasonable explanation for the delay.
